Zippy Market — Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of Zippy Market, a local instant-pickup marketplace available at market.zippydoes.com (the “Service”). Zippy Market is operated by Zippy Services LLC (“Zippy,” “we,” “us,” or “our”).

By creating an account, listing an item, making a purchase or offer, claiming a free item, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Zippy Market is a separate product from the Zippy services platform at zippydoes.com. Although both are operated by Zippy Services LLC and share a single login, these Terms apply only to Zippy Market. Your use of zippydoes.com is governed by that platform’s own terms.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By using Zippy Market you represent that you meet these requirements and that all information you provide is accurate.

2. Your account

Some features require an account. Zippy Market uses the same login system as zippydoes.com, so a single set of credentials may work across both products; however, your Zippy Market buyer and seller profiles are maintained separately. You are responsible for keeping your password secure and for all activity under your account. Notify us promptly at support@zippydoes.com if you suspect unauthorized use.

To protect privacy, buyers and sellers are shown to one another only by anonymized handles (for example, “Buyer #1234” or “Seller #5678”). We do not display your email address to other users.

3. How Zippy Market works

Zippy Market lets sellers list items that are dropped into a smart locker for buyers to pick up. Listings come in three types:

  • Sale — a paid listing with a Buy Now price and an optional Make-an-Offer flow, processed through Stripe.
  • Free give-away — a public $0 listing that anyone can claim with just an email address. No payment is involved.
  • Private handoff — a $0 drop-off for a specific named recipient (for example, leaving a key). It is never shown publicly and no payment is involved.

Zippy Market provides the venue, technology, and locker hardware that facilitate these transactions. Except where we are the seller, we are not a party to the transaction between buyer and seller and do not take ownership of listed items.

4. Buying and picking up items

  • Payment. Paid purchases are processed by Stripe. By buying, you authorize the charge for the item price plus any applicable amounts shown at checkout. You may check out as a guest; we may create an account for you so you can track your order.
  • Pickup. After payment clears (or after you claim a free or handoff item), you receive a unique unlock link. Use it, tap Unlock, and the assigned locker opens. You are responsible for retrieving your item promptly and for the item once the locker is opened.
  • The unlock link is your credential. For free give-aways and private handoffs, the emailed unlock link is the only credential needed for pickup — keep it private. For paid purchases, unlocking also requires you to be signed in.
  • All sales are generally final. Because items are local, second-hand, and handed off immediately, sales are final except as required by law or as described in Section 9. Inspect your item at pickup.

5. Offers, counter-offers, and auto-accept

On paid listings you may submit an offer below the Buy Now price. Submitting an offer places a temporary authorization hold on your payment method through Stripe; funds are only captured if the seller accepts (or if your offer meets the seller’s auto-accept threshold). Offers expire automatically if not accepted within the posted window, and a seller may decline or counter your offer. Holds for declined, cancelled, or expired offers are released. You may edit or cancel a pending offer before it is accepted.

5a. Rentals

Some listings are offered for rent by the day or week rather than for sale. Rentals require a signed-in account and a one-time government-ID verification performed by Stripe Identity (Zippy Market never stores your ID images). By completing a rental checkout you agree to all of the following:

  • Rental period. Your rental period begins when you pick the item up from the locker and ends the stated number of days or weeks later. You must return the item to the same locker you picked it up from by the due date, in the condition you received it.
  • Automatic overdue charges.If the item is not returned by the due date, you authorize Zippy Market to charge your saved payment method the listing’s daily rate for each additional day, without further action by you, until the item is returned or until cumulative overdue charges reach the disclosed maximum (the item’s replacement cost plus platform fees). These are merchant-initiated transactions you consent to at checkout. Returning the item stops further charges immediately.
  • Buy-out. If cumulative overdue charges reach the disclosed maximum, the rental converts to a purchase: the item is yours, the seller has been paid its replacement value, and no further charges occur.
  • Failed charges and unreturned items. If overdue charges cannot be collected and the item is not returned, we may pursue recovery of the item or its value, including through your verified identity, as permitted by law.
  • Condition disputes. After you return the item, the seller may report damage or missing parts. We will review reported problems and may facilitate a resolution between you and the seller; any additional charge for damage will not be made without notice to you.

6. Selling items

By listing an item for sale, you agree that:

  • Payouts go through Stripe.To sell and get paid you must set up a Stripe account. Your earnings are paid out to your bank by Stripe and are subject to Stripe’s terms. Free give-aways and handoffs do not require Stripe.
  • Commission. Zippy Market retains a 10% fee of the final sale price the buyer actually pays (for example, an accepted offer amount, not your original listing price). You receive the remaining 90%, less any Stripe processing fees.
  • Lockers are first-come, first-served. Locker space is limited. If no locker is available, your item cannot be listed until one frees up.
  • Listings go live only after drop-off. Creating a listing reserves a locker but does not make the item visible. Buyers can see it only after you physically place it in the locker and mark it ready. Listings not dropped off within 24 hours are cancelled automatically and the locker is freed.
  • Accurate listings. You must describe your item honestly, including its condition, and you must have the legal right to sell it. You are solely responsible for your item, its legality, its condition, and any taxes on your sales.
  • Retrieval. If you cancel a listing for an item already in a locker, you must retrieve it and confirm retrieval so the locker can be reused.

7. Prohibited items and conduct

You may not list, sell, give away, or hand off anything that is illegal, unsafe, stolen, counterfeit, recalled, or that you do not have the right to transfer. Prohibited items include (without limitation) weapons and ammunition, illegal drugs and paraphernalia, hazardous or perishable materials, live animals, recalled goods, adult or sexually explicit material, and anything that infringes intellectual-property rights or violates applicable law.

We use automated tools (including AI moderation) and human review to screen listings, and we may remove or refuse any listing, cancel any transaction, or suspend any account at our discretion. You also agree not to misuse the Service — including tampering with lockers, attempting to access lockers or items that are not yours, defeating security measures, scraping, or interfering with the Service or its hardware.

8. Lockers and the pickup location

Lockers and the pickup location are provided for completing Zippy Market transactions only. You agree to use them lawfully and as directed, to open only the locker assigned to your transaction, and to retrieve your own item promptly. The pickup location is monitored by video surveillance for safety and security. Do not leave prohibited items, trash, or anything other than your listed item in a locker.

Every locker-opening action requires you to confirm you are present at the locker before it opens, because the door releases on a short timer once triggered. Do not trigger an unlock unless you are ready to retrieve your item.

9. Refunds, disputes, and our role

Except where we are the seller, transactions are between the buyer and the seller, and Zippy Market acts as a venue and payment facilitator — not as the buyer, seller, or a party to the sale. If something goes wrong with a transaction, contact us at support@zippydoes.com and we will try to help, including by facilitating a refund through Stripe where appropriate. We do not guarantee the quality, safety, legality, or condition of any item, or that a buyer or seller will complete a transaction.

10. Reviews and your content

You may submit photos, listing details, reviews, questions, and other content (“User Content”). You retain ownership of your User Content, but you grant Zippy Services LLC a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and use it to operate, improve, and promote the Service. You are responsible for your User Content and represent that you have the rights to share it. Reviews must be honest and based on a genuine transaction; we may remove content that is false, abusive, infringing, or otherwise violates these Terms.

11. Intellectual property

The Service, including its software, design, branding, and the “Zippy” and “Zippy Market” names and logos, is owned by Zippy Services LLC and protected by intellectual-property laws. Except for the rights expressly granted to you to use the Service, no rights are transferred to you.

12. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY ITEM LISTED WILL MEET YOUR EXPECTATIONS. ITEMS ARE OFFERED BY THIRD-PARTY SELLERS, AND ANY DISPUTE ABOUT AN ITEM IS BETWEEN THE BUYER AND THE SELLER.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ZIPPY SERVICES LLC AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR ITEMS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TO US IN CONNECTION WITH THE TRANSACTION GIVING RISE TO THE CLAIM, OR US $100. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless Zippy Services LLC and its owners, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your User Content, your items, or your violation of these Terms or of any law or third-party right.

15. Suspension and termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or to protect the Service, its users, or our hardware. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive.

16. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

17. Governing law and venue

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Texas, and you consent to the personal jurisdiction of those courts.
